Formation of the institutional environment in the sphere of the subsoil use (both of Russia and Ukraine) was significantly carried out spontaneously, under the influence of the certain dominating political and business groups. Currently, the institutional transformations in the sphere of the subsoil use of Russia and Ukraine consider interests of the states as proprietors of natural resources and society in an incomplete measure. Priority problems and complex of organizational-legal actions of institutional reforming of Russian and Ukrainian spheres of the subsoil use are detected. In this article is noted the necessity of prime reforming of the following systems: system of the legal subsoil use management; the economic mechanism of regulation of the subsoil use; systems of the budget formation due to mining and other kinds of natural rent, and also creation of economic-legal institute of the civil property on the subsoil resources and other natural resources; mineral and raw material stock exchanges; industrial clusters.
